This is the full terms and conditions from Man And Van Services LLC operating in Dubai, UAE.
1. Definitions
Key terms include AED (UAE Dirhams), Additional Charges/Services, Applicable Laws, Commencement Date, Employee, Premises, Services, Service Charge, Term, and UAE.
2. Commencement and Provision
This Agreement shall come into effect on the Commencement Date and shall continue for the duration of the Term until terminated. Services purchased via website deliver to customer-specified locations. All persons using and purchasing the Services on Man And Van website at www.Manandvan.ae must be over 18.
3. Payment of Service Charges
Payment methods include debit/credit card, bank transfer, or cheque. Payment can only be made in UAE Dirhams and Visa and/or MasterCard only will be accepted. Monthly maintenance requires three consecutive payments before first preventive maintenance. Late payment fees apply at 2% monthly on overdue amounts.
4. Man And Van Responsibilities
Provider supplies consumables/spare parts (charged at cost plus 15% or free for Elite contracts). Services rescheduled at no cost if weather prevents completion. Company will not be held responsible for any damage during response time to callouts.
5. Customer Responsibilities
Customers ensure employee access to premises (AED 280 minimum fee if access unavailable), provide amenities like water/electricity, maintain adequate insurance, and authorize additional services before charging.
6. Warranties
Thirty (30) days' workmanship warranty on all maintenance services and installed items. Company won't trade with OFAC-sanctioned countries.
7. Indemnification
Customers responsible for employee safety and indemnify company against claims arising from customer acts or omissions.
8. Suspension and Termination
Immediate suspension possible for non-payment. Either party may terminate with 60 days' notice, but customer pays 2 monthly payments or full quarterly value, whichever is greater.
9. Cancellation
Cancellations less than 24 hours prior incur AED 150 minimum one-hour charge. Contract maintenance requires confirmation within 2 business days; rescheduling allowed once.
10. Property Systems
Provider charges additional fees for corrective maintenance if systems aren't functioning properly and cannot be held responsible for loss or damage from deficient property systems.
11. Excessive Callout Consumption
Beyond 15 apartment or 35 villa callouts annually, additional routine callouts charged at AED 225 per callout for 2 hours labour time and additional hours at AED 100 per hour.
12. Governing Law
Dubai and UAE federal laws apply.
13. Dispute Resolution
Dubai Court resolves disputes per UAE law.
14. General
This agreement supersedes prior understandings. Company may subcontract services.
15. Annual Maintenance Package Terms
Response times subject to traffic, excessive callout thresholds, and Elite contract benefits apply as specified in the relevant service agreement.
